Terms of Service — CheckMyPower

1. Acceptance of Terms

Dopamine Research, LLC ("Company," "we," "us," or "our") operates CheckMyPower.com (the "Site") and provides an automated electrical panel assessment service (the "Service"). By accessing the Site, uploading a panel photo, purchasing a report, or otherwise using the Service, you ("user," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

You must affirmatively accept these Terms by clicking "I agree to the Terms of Service" prior to completing your purchase. Your click constitutes a legally binding acceptance of all terms contained herein.

2. Description of Service

The Service allows homeowners to upload a photograph of their electrical panel and receive an automated report estimating whether their home's electrical system can support a new high-draw appliance (EV charger, hot tub, sauna, pool equipment, or tankless water heater). The report is generated using automated image analysis and NEC 220.82-based load calculations applied to data you provide (appliance type, square footage) and data extracted from your photo.

3. Informational Purposes Only — Not Professional Advice

THE SERVICE IS PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. CheckMyPower.com is not a licensed electrical contractor, electrician, engineer, or inspector, and does not provide professional electrical advice, engineering opinions, building code compliance determinations, or guarantees of electrical capacity.

The automated reports generated by the Service are estimates based on limited inputs and automated image analysis. They are not a substitute for an in-person inspection by a licensed, qualified electrician. Estimates may be incomplete, inaccurate, or inapplicable to your specific situation due to factors including but not limited to:

Image quality, lighting, angle, or resolution of the uploaded photo
Non-standard, modified, or unusual panel configurations
Local code amendments or jurisdictional requirements that differ from the NEC
Existing wiring conditions, conductor sizing, or grounding issues not visible in the photo
Concealed loads, sub-panels, or circuits not captured in the image
Inherent limitations of automated image analysis and AI-based data extraction
Errors or omissions in the information you provide (square footage, appliance type)

You must consult a licensed, qualified electrician before making any decisions regarding electrical installations, modifications, upgrades, or appliance purchases.

4. Cost Estimates Disclaimer

The report may include estimated costs for electrical panel upgrades or related work. These cost estimates are approximate, general in nature, and are not quotes, bids, proposals, or guarantees of actual cost. Actual costs vary significantly based on your geographic region, local labor rates, material costs, permitting fees, scope of work, the condition of your existing electrical system, and other factors. You should obtain quotes from licensed electricians in your area before making any financial decisions. Dopamine Research, LLC is not responsible for any difference between estimated costs shown in a report and actual costs incurred.

5. Assumption of Risk

YOU ASSUME ALL RISK. You acknowledge and agree that any decisions you make regarding electrical installations, purchases, upgrades, or modifications based in whole or in part on information obtained through the Service are made entirely at your own risk. You are solely responsible for verifying all information contained in any report before taking any action based on it.

6. Disclaimer of Warranties

THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY REPORT WILL BE ACCURATE, COMPLETE, OR RELIABLE. WE DO NOT WARRANT THAT THE AUTOMATED IMAGE ANALYSIS OR LOAD CALCULATIONS WILL CORRECTLY IDENTIFY OR ASSESS YOUR ELECTRICAL PANEL OR ITS CAPACITY.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOPAMINE RESEARCH, LLC, ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR RELIANCE ON THE SERVICE OR ANY REPORT, INCLUDING BUT NOT LIMITED TO: PROPERTY DAMAGE, PERSONAL INJURY, ELECTRICAL FIRES, EQUIPMENT DAMAGE, VOIDED WARRANTIES, BUILDING CODE VIOLATIONS, FINES, PENALTIES, LOSS OF USE, LOSS OF PROFITS, OR COST OF SUBSTITUTE SERVICES.

THIS LIMITATION APPLIES REGARDLESS OF WHETHER SUCH LIABILITY ARISES IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE TOTAL, CUMULATIVE LIABILITY OF DOPAMINE RESEARCH, LLC ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SPECIFIC REPORT GIVING RISE TO THE CLAIM (I.E., $14.99). THIS LIMITATION APPLIES TO ALL CLAIMS IN THE AGGREGATE.

8. Exclusive Remedy

Your sole and exclusive remedy for any dissatisfaction with the Service, any inaccuracy in a report, or any claim arising from or related to the Service is a refund of the $14.99 fee paid for the report in question. Refunds may be issued at our sole discretion or automatically in cases where a panel photo is determined to be unreadable. By using the Service, you agree that this refund constitutes your sole and exclusive remedy and that you waive any and all other claims, causes of action, and remedies against Dopamine Research, LLC.

9. Third-Party Services and Errors

The Service relies on third-party providers for image analysis (vision API), payment processing (Stripe), CAPTCHA / abuse prevention, and hosting infrastructure. We are not responsible for any errors, omissions, inaccuracies, failures, delays, or interruptions caused by or originating from any third-party service, including but not limited to:

Errors in data extracted from your panel photo by the vision API
Incorrect, incomplete, or failed image analysis
Payment processing failures or delays
CAPTCHA false positives or service unavailability
Server downtime, data loss, or infrastructure failures

Your use of third-party services integrated into the Service is subject to those parties' own terms and privacy policies.

10. Indemnification

You agree to indemnify, defend, and hold harmless Dopamine Research, LLC, its owners, members, officers, agents, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or reliance on the Service or any report; (b) any electrical work, appliance installation, purchase decision, or other action you take based on information from the Service; (c) your violation of these Terms; (d) your violation of any applicable law, regulation, or building code; or (e) any claim by a third party related to your use of the Service.

11. Mandatory Individual Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Agreement to Arbitrate. You and Dopamine Research, LLC mutually agree that any dispute, claim, or controversy arising out of or relating to the Service, these Terms, or any report generated by the Service ("Dispute") shall be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may bring an individual action in small claims court if the claim qualifies.

Arbitration Rules. Arbitration shall be administered by JAMS under its Streamlined Arbitration Rules and Procedures, or by another mutually agreed-upon arbitration provider. The arbitration shall take place in Los Angeles County, California, or at another mutually agreed-upon location. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

No Class Actions. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN OR BRING A CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY. The arbitrator may not consolidate proceedings or preside over any form of representative or class proceeding.

Opt-Out Right. You may opt out of this arbitration and class action waiver provision by sending written notice to support@checkmypower.com within thirty (30) days of your first use of the Service.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. To the extent that arbitration does not apply (including if you timely opt out under Section 11), any legal action or proceeding shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.

13. Statute of Limitations

You agree that any claim or cause of action arising out of or related to the Service or these Terms must be filed within one (1) year after the cause of action accrues. Any claim not filed within this period is permanently barred.

14. Payment and Refund Policy

The Service costs $14.99 per report. Payment is processed by Stripe, Inc. at the time of purchase. If the uploaded panel photo is determined by our system to be unreadable or insufficient for analysis, the charge will be automatically refunded. Beyond the auto-refund for unreadable photos, refunds are issued at our sole discretion. As stated in Section 8, a refund of the $14.99 fee is your sole and exclusive remedy. 15. Acceptable Use

You agree not to:

Upload photos that are not of your own electrical panel or a panel you have legal authority to photograph
Use the Service for any commercial electrical inspection, contracting, or engineering purpose
Circumvent rate limits, CAPTCHA protections, or other abuse-prevention measures
Use the Service in any way that violates applicable law or regulation
Reverse-engineer, scrape, or attempt to extract the underlying logic or algorithms of the Service

We reserve the right to suspend or terminate your access to the Service for any violation of this section.

16. Intellectual Property

All content, software, algorithms, reports, design elements, trademarks, and other intellectual property associated with the Site and Service are owned by or licensed to Dopamine Research, LLC. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent. Reports generated by the Service are licensed to you for personal, non-commercial use only.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, the remaining provisions shall continue in full force and effect. If the class action waiver in Section 11 is found to be unenforceable, then the entirety of the arbitration provision shall be null and void (but all other Terms shall remain in effect).

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dopamine Research, LLC with respect to the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the revised Terms on the Site with a new effective date. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
